TERMS AND CONDITIONS – SOUVE
I. GENERAL PROVISIONS
1.1. The online store available at www.souve.eu, including its progressive web application (PWA) and any mobile or digital interfaces enabling access to the Store (hereinafter jointly referred to as the “Store”), is operated by Souve Szymon Machniak, with its registered business address at ul. Dunikowskiego 14/7, 40-127 Katowice, Poland, entered in the relevant business registers under NIP 6343065999, VAT EU PL6343065999 and REGON 543748399 (hereinafter referred to as the “Seller”, “we” or “us”).
The online store available at www.souve.eu, including its progressive web application (PWA) and any mobile or digital interfaces enabling access to the Store (hereinafter jointly referred to as the “Store”), is operated by Souve Szymon Machniak, with its registered business address at ul. Dunikowskiego 14/7, 40-127 Katowice, Poland, entered in the relevant business registers under NIP 6343065999, VAT EU PL6343065999 and REGON 543748399 (hereinafter referred to as the “Seller”, “we” or “us”).
The Seller is also the controller of personal data processed in connection with the use of the Store. Detailed information regarding the processing of personal data is provided in the Privacy Policy available on the Store’s website.
These Terms and Conditions (hereinafter the “Terms”) set out the rules for purchasing Products available in the Store, creating and maintaining a Customer Account, using Electronic Services, participating in promotional campaigns and using other functionalities offered within the Store.
The Terms are made available free of charge on the Store’s website in a manner enabling their acquisition, reproduction and storage, including downloading and saving the current version in electronic form.
All information presented in the Store, including Product descriptions, prices, photographs, specifications and marketing content, constitutes an invitation to conclude a contract within the meaning of applicable law, in particular Article 71 of the Polish Civil Code, and does not constitute an offer within the meaning of legal provisions.
Products available in the Store are presented with due care. The Store provides information in particular regarding the main characteristics of the Product, its price, composition, materials and other relevant features, to the extent resulting from the nature of the Product.
All trademarks, trade names, graphic elements, product descriptions, images, layouts, technological solutions and other elements of the Store are protected by intellectual property rights and may not be used, copied, reproduced or distributed without prior written consent of the Seller or the respective rights holder.
Use of the Store requires acceptance of these Terms and compliance with applicable law. Nothing in these Terms shall exclude or limit Consumer rights granted under mandatory provisions of law.
II. DEFINITIONS
Store – the online store operated by the Seller and available at souve.eu.
Seller – Souve Szymon Machniak, with business details indicated above.
Customer – any natural person, legal entity or organizational unit using the Store.
Consumer – a natural person acting for purposes outside their trade, business or profession.
Entrepreneur – a person or entity acting in connection with business activity.
Entrepreneur with Consumer Rights – a natural person entitled to statutory consumer protections under applicable law despite acting in connection with business activity.
Product – goods offered for sale in the Store.
Partner Product – a Product fulfilled or delivered with the participation of an external warehouse, logistics provider or fulfillment partner.
Order – a declaration of intent submitted by the Customer through the Store aimed at concluding a Sales Agreement.
Sales Agreement – the agreement for sale of Products concluded between the Seller and the Customer after acceptance of the Order by the Seller.
Customer Account – an individual account in the Store’s IT system allowing the Customer to use additional functionalities.
Electronic Services – services provided electronically through the Store, including in particular Customer Account, Wishlist, Newsletter, forms, communication tools and related digital features.
Digital Services – digital functionalities and services connected with the Store, including PWA, account functionalities, personalization tools and future mobile or platform-based features.
Shopping Cart – a virtual tool used to collect selected Products before placing an Order.
Delivery – the service of transporting the Product to the Customer through a Carrier or fulfillment partner.
Carrier – a courier, postal operator or other logistics provider cooperating with the Seller.
Payment Operator – an external provider enabling electronic payment processing.
Promotion – a temporary commercial campaign allowing the Customer to obtain a discount, special offer or other benefit.
Discount Code – a sequence of characters enabling the Customer to receive a discount or other promotional benefit.
Gift Card – a voucher or digital equivalent allowing payment for Products up to the available amount.
Privacy Policy – a separate document governing the processing of personal data in connection with the Store.
Cookies Policy – a separate document governing cookies and similar technologies used in the Store.
Working Days – days from Monday to Friday excluding public holidays in Poland.
III. TECHNICAL REQUIREMENTS
Use of the Store requires Internet access, an active email address, a device capable of accessing the Internet and a current web browser supporting cookies, JavaScript and secure HTTPS connections. The Store is designed to function in modern versions of commonly used browsers, including Chrome, Safari, Firefox and Edge.
Some functionalities of the Store may not operate properly if browser settings block cookies, scripts or local storage required for the Store’s operation. The Customer is responsible for ensuring that the device used to access the Store is adequately protected against unauthorized access, malware and other security risks.
The Seller makes reasonable efforts to ensure proper operation of the Store, but temporary interruptions, maintenance windows, updates or technical failures may occur.
IV. ELECTRONIC SERVICES
The Store provides Electronic Services free of charge, including browsing the catalog, managing the Shopping Cart, creating and maintaining a Customer Account, subscribing to the Newsletter, using contact forms, using Wishlist functionality, receiving system notifications and using digital shopping assistance features.
The Seller may develop, modify, suspend or extend Electronic Services over time in order to improve functionality, security, legal compliance or the shopping experience. Some Electronic Services may depend on third-party infrastructure, hosting, integrations, payment systems, customer service tools or analytics technologies.
The Customer is obliged to use Electronic Services in accordance with law, good practice and these Terms. It is prohibited in particular to provide unlawful content, interfere with the Store’s systems, attempt unauthorized access, scrape data, use bots without permission, or use the Store in a manner inconsistent with its intended purpose.
V. CUSTOMER ACCOUNT
Creating a Customer Account is voluntary and free of charge. The Account may enable faster checkout, order history access, address storage, preference management, Newsletter settings, Wishlist access and other functionalities provided by the Seller.
The Store may permit registration or login using third-party providers such as Google, Facebook, TikTok, LinkedIn and X. In such cases, certain data may be received from the external provider according to permissions granted by the Customer. The Seller is not responsible for the operation or privacy practices of third-party authentication providers.
The Customer is responsible for maintaining the confidentiality of account credentials and for all activity conducted through the Account, unless unauthorized use results solely from causes not attributable to the Customer. The Seller may suspend or restrict an Account where necessary for security, fraud prevention, legal compliance or protection of the Store and other users.
The Customer may delete the Account at any time. The Seller may remove or anonymize inactive Accounts after a prolonged period of inactivity in order to ensure system performance, data minimization and security, subject to applicable law.
VI. ORDERS
The Souve Online Store enables Customers to place Orders for Products available in the Store through electronic means, including via the website, progressive web application (PWA) and other digital interfaces made available by the Seller. Orders may be placed 24 hours a day, 7 days a week, subject to temporary technical interruptions, maintenance or limitations resulting from external service providers.
The process of placing an Order consists in particular of selecting Products available in the Store, adding selected Products to the Shopping Cart, proceeding to checkout, providing delivery details, selecting a delivery and payment method, accepting these Terms and confirming the Order. Before placing an Order, the Customer is provided with a summary including the total price, delivery costs, selected Products and payment method.
Submitting an Order constitutes an offer by the Customer to conclude a Sales Agreement with the Seller. The Sales Agreement is concluded only upon acceptance of the Order by the Seller. Acceptance may take place through explicit confirmation of the Order, dispatch of the Product or commencement of order processing. An automatic confirmation of Order receipt does not constitute acceptance of the Order.
The Seller reserves the right to verify Orders in order to ensure transaction security, prevent fraud, verify payment authorization or confirm Product availability. Verification may include contacting the Customer, temporary suspension of Order processing, additional verification of payment or identity and risk analysis using automated systems.
The Seller reserves the right to cancel or refuse acceptance of an Order before or at the stage of verification in particular in the case of lack of Product availability, pricing errors, technical errors in the Store system, incomplete or incorrect Customer data, suspected fraudulent activity, payment failure, abuse of promotions, bulk purchasing inconsistent with Store policy or circumvention of security measures.
The Store offers Products sourced from multiple suppliers and logistics partners. Product availability is dynamic and may change in real time. In exceptional cases, a Product may become unavailable after the Order has been placed. In such case, the Seller may inform the Customer and offer a replacement Product, partially fulfill the Order or cancel the Order in whole or in part and refund the Customer.
An Order may be fulfilled in parts, especially where Products are sourced from different warehouses or fulfillment partners. In such cases, Products may be delivered separately, delivery times may vary between shipments and the Customer may receive multiple tracking numbers. Partial deliveries do not affect the validity of the Sales Agreement.
The Seller may introduce reasonable Order limits regarding quantity, frequency or categories of Products in order to ensure fair access to Products, prevent abuse, support stock integrity and protect the Store’s operations.
VII. PRICES AND PAYMENTS
Prices of Products presented in the Store are displayed together with the Product description. Unless otherwise indicated, all prices include applicable taxes (VAT). The total price payable by the Customer is indicated during checkout and includes in particular the price of the Product, applicable taxes, delivery costs if applicable and any additional charges selected by the Customer.
Prices may be displayed in different currencies depending on the Customer’s location, selected delivery country or Store configuration. The final currency used for payment is presented during checkout. The final transaction amount may depend on currency conversion rates applied by the payment service provider or the Customer’s bank. The Seller is not responsible for exchange differences, commissions or other charges imposed by third parties.
The Store provides secure electronic payment methods. Available payment methods may include in particular card payments, digital wallets such as Apple Pay and Google Pay, and payment systems offered by external payment operators including Stripe and Przelewy24. The availability of a given payment method may depend on the destination country, device, transaction value or operational settings.
The Seller does not store full payment card data. Payment details are processed directly by payment providers under their own terms and security standards. Execution of an Order may require successful payment authorization. If payment authorization fails, the Order may not be accepted for processing.
If the Customer fails to complete payment within the required time, the Order may be automatically cancelled. The Seller is not responsible for delays caused by payment systems, banking systems, payment providers or technical problems not attributable to the Seller.
The Seller makes reasonable efforts to ensure that all prices displayed in the Store are accurate and up to date. However, in exceptional cases, errors in price presentation may occur due to technical or system-related reasons. If an obvious pricing error occurs, including but not limited to a price significantly lower than the market value of the Product, the Seller reserves the right to cancel the Order, refuse to conclude the Sales Agreement or contact the Customer to confirm whether the Customer wishes to proceed at the correct price.
Refunds are processed using the same payment method used by the Customer unless otherwise agreed. Refunds may be issued in particular in cases of withdrawal from the contract, return of Products, cancellation of the Order or accepted complaint. The Seller may withhold the refund until the returned Product is received or proof of return is provided, where permitted by law.
If the Customer initiates a chargeback or payment dispute through a bank or payment provider, the Seller reserves the right to suspend Order processing, suspend the Customer Account, block further transactions and take lawful steps to protect its interests. The Customer is encouraged to contact the Seller before initiating a chargeback in order to resolve the matter directly.
VIII. DELIVERY
The Seller delivers Products ordered through the Store to the address indicated by the Customer during checkout. Delivery is carried out through logistics operators, courier companies or other fulfillment partners cooperating with the Seller. Depending on the Product, destination country, stock location and logistics model, delivery may be performed by different carriers or fulfillment partners.
The Store conducts sales primarily within the European Union. Delivery availability for a specific country, region or postal code may depend on operational capabilities, customs requirements, warehouse location or Product-specific restrictions. The Seller may limit delivery availability for selected Products or destinations where justified by logistics, legal or operational reasons.
Delivery methods may include courier delivery, standard parcel delivery, express delivery or other delivery models offered by cooperating logistics providers. Delivery costs are displayed during checkout and may depend on the destination, selected method, Order value, Product category or ongoing promotions.
The estimated delivery time is presented during checkout or in the Product information area. Delivery times are indicative only and do not constitute a guaranteed delivery deadline unless explicitly stated otherwise. Delays may occur in particular due to high sales periods, carrier overload, stock synchronization delays, technical disruptions, customs issues, external logistics problems or force majeure.
Where Products included in one Order are stored in different warehouses, fulfilled by different partners or become available at different times, the Seller may deliver the Order in multiple separate shipments. The Customer may receive separate dispatch notifications and different tracking numbers. Split shipment does not in itself constitute improper performance by the Seller.
Some Products may be fulfilled through external logistics partners or warehouse operators cooperating with the Seller. Despite the involvement of such partners, the Seller remains the contractual counterparty of the Customer and remains responsible for proper performance of the Sales Agreement, subject to mandatory legal provisions.
In the case of a Consumer, the risk of accidental loss of or damage to the Product passes to the Consumer only upon delivery to the Consumer or a third party designated by the Consumer other than the carrier, unless mandatory law provides otherwise. The Customer is encouraged to inspect the shipment upon receipt and report visible damage or irregularities promptly.
Where available, the Seller may provide tracking information by e-mail, within the Customer Account or through a carrier link. The availability, scope and accuracy of tracking information may depend on systems operated by third-party carriers.
The Customer is responsible for providing a complete and accurate delivery address. If delivery fails because of incorrect address data, absence of the recipient, refusal without legal basis or other reasons attributable to the Customer, the shipment may be returned, held or redirected in accordance with the carrier’s procedures. In such cases, the Seller may contact the Customer, require payment of justified re-shipment costs where lawful or treat the Order as undeliverable if delivery becomes impossible.
If the parcel is lost, significantly delayed or delivered incorrectly, the Customer should notify the Seller as soon as possible. The Seller may initiate a logistics investigation with the carrier or fulfillment partner and may request additional information from the Customer. Resolution time may depend on third-party procedures.
IX. RIGHT OF WITHDRAWAL AND RETURNS
If the Customer is a Consumer, the Customer has the right to withdraw from the Sales Agreement without giving any reason within 14 days, subject to mandatory legal exceptions. The withdrawal period expires after 14 days from the day on which the Customer, or a third party indicated by the Customer other than the carrier, acquires physical possession of the Product. For Orders consisting of multiple Products delivered separately, the withdrawal period expires after receipt of the last Product.
To exercise the right of withdrawal, the Customer must inform the Seller about the decision to withdraw from the contract by means of a clear statement. This may be done through the return system available in the Store, electronic communication, or a return form made available by the Seller. Use of a model withdrawal form is optional.
After submitting a withdrawal or return request, the Customer will receive return instructions, including the appropriate return address and, where applicable, a return label or other logistical guidance. Returned Products must be sent exclusively to the return address provided by the Seller during the return process.
The return address may vary depending on Product type, warehouse location, logistics partner or fulfillment model used for the Order. The Seller’s registered business address is not a return address, unless the Customer is expressly instructed otherwise in writing. Sending a Product to an incorrect address may result in delays, inability to identify the return or temporary refusal to process the return until the shipment is correctly delivered and identified.
The Customer should send the Product back without undue delay and no later than 14 days from the day on which the withdrawal was communicated. To meet the deadline, it is sufficient to dispatch the Product before expiry of the return period.
The Customer bears the direct cost of returning the Product unless the Seller expressly states otherwise. The cost of return may depend on the carrier selected by the Customer or the method indicated by the Seller.
The Customer is liable for any diminished value of the Product resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the Product. Returned Products should be complete, reasonably undamaged and properly secured for transport. The Seller may accept Products that have been unpacked or tried on to the extent necessary to inspect them, subject to applicable law.
In the event of valid withdrawal, the Seller shall reimburse all payments received from the Customer, including the cost of the least expensive standard delivery option offered by the Seller, unless mandatory law provides otherwise. The refund will be made without undue delay and no later than 14 days from the date on which the Seller is informed of the withdrawal. The Seller may withhold the refund until the Product is received or proof of return is provided, where permitted by law.
The right of withdrawal does not apply in cases provided by law, including in particular Products made to the Customer’s specifications, clearly personalized Products, sealed Products not suitable for return for health or hygiene reasons if unsealed after delivery, and digital content delivered electronically once performance has begun with the Customer’s prior consent and acknowledgment where applicable.
Where an Order includes Products fulfilled from different warehouses or partners, the Customer may receive separate return instructions for different Products. The Customer is required to follow the specific return instructions applicable to each Product or shipment. If a returned Product cannot be identified because of missing Order reference or incorrect shipment, the Seller may suspend return handling until clarification is obtained.
The Seller reserves the right to refuse acceptance of a return where the Product is sent to an incorrect address, the return does not comply with these Terms, the Product shows signs of excessive use beyond ordinary inspection or legal conditions for withdrawal are not met. The Seller shall not be liable for loss, damage or delay of returned Products sent using a method not recommended or not indicated by the Seller. The risk of return shipment remains with the Customer until the Product is received at the correct return address.

X. COMPLAINTS AND LIABILITY
The Seller is obliged to deliver Products that are in conformity with the Sales Agreement and applicable legal provisions. If a Product is not in conformity with the contract, the Customer may exercise rights arising from applicable consumer protection laws, including repair, replacement, price reduction or withdrawal from the contract, subject to legal conditions. These rights are granted under mandatory law and are not excluded or limited by these Terms.
The Customer may submit a complaint through the Store’s complaint system, by e-mail to hello@souve.eu or through other contact channels made available by the Seller. To facilitate processing, the Customer should provide the Order number, a description of the issue, photographs if applicable and contact details. Failure to provide such information does not prevent submission of a complaint but may delay processing.
After receiving the complaint, the Seller may analyze the issue, request additional information, inspect the Product, consult with suppliers or logistics partners, or perform technical analysis where applicable. The Seller will respond within the timeframe required by applicable law.
If the complaint is accepted, the Seller may, depending on circumstances and legal requirements, repair the Product, replace it, reduce the price or refund the Customer. The method of resolving the complaint depends on the nature of the defect, the Customer’s request and applicable law.
If return of the Product is necessary in order to assess the complaint, the Seller will provide return instructions and the appropriate return address. The provisions governing return addresses in the Returns section apply accordingly.
The Customer is obliged to cooperate with the Seller in the complaint process, in particular by providing necessary information or delivering the Product where required. The duration of the complaint process may depend on complexity, third-party involvement or logistics conditions.
The Seller shall not be liable for defects resulting from improper use of the Product, including use inconsistent with its intended purpose, improper storage, mechanical damage caused by the Customer or third parties, or normal wear and tear.
To the extent permitted by law, the Seller’s liability towards Customers who are not Consumers is limited. In particular, the Seller shall not be liable for indirect damages, lost profits, loss of data or other purely economic losses, unless mandatory law provides otherwise.
The Seller makes reasonable efforts to ensure uninterrupted operation of the Store but shall not be liable for temporary unavailability caused by maintenance, system failures, external service providers, cyber incidents or force majeure. The Seller also uses services provided by third parties, including payment providers, logistics operators and IT providers, and shall not be liable for actions or omissions of such third parties except to the extent required by applicable law.
The Seller shall not be liable for failure or delay in performance resulting from circumstances beyond reasonable control, including natural disasters, strikes, war, cyberattacks, disruptions in supply chains, actions of public authorities or similar force majeure events.
XI. FRAUD PREVENTION, SECURITY AND ACCOUNT CONTROL
The Seller implements technical and organizational measures designed to ensure the security of transactions carried out through the Store and to protect Customers and the Seller against fraudulent activity. Such measures may include automated systems, risk assessment tools, behavioral analysis mechanisms and cooperation with payment providers and external security services.
Orders placed in the Store may be subject to automated risk assessment mechanisms. These systems may analyze factors related to the transaction, including payment data consistency, transaction patterns, device and browser characteristics, IP address and location data, history of previous transactions and behavioral indicators suggesting abnormal activity.
If a transaction is identified as potentially suspicious, the Seller may temporarily suspend Order processing, request additional verification from the Customer, contact the Customer to confirm transaction details or cancel the Order where justified. Verification may require additional information necessary to ensure the security of the transaction.
The Seller reserves the right to refuse acceptance or processing of an Order in cases where there is a justified suspicion of fraud, abuse or violation of these Terms. This may apply in particular where there is inconsistency in payment data, multiple suspicious transactions are detected, the Customer attempts to circumvent security measures, or the transaction is flagged by payment providers or fraud detection systems.
The Seller may suspend or restrict access to a Customer Account where it is necessary to ensure the security of the Store, protect other users or prevent abuse. Such actions may include temporary suspension of the Account, blocking access to certain functionalities, limiting the ability to place Orders or requiring additional verification.
The Seller reserves the right to take appropriate action in cases of abuse of promotions, discount codes or marketing campaigns, including using multiple accounts to obtain unauthorized benefits, circumventing promotion rules, automated or bulk use of discount codes or actions inconsistent with the purpose of the promotion. In such cases, the Seller may refuse to apply the promotion, cancel the Order, restrict access to promotional benefits or permanently block access to the Store in cases of serious or repeated violations.
The use of automated tools, bots or scripts to interact with the Store, including placing Orders, scraping data or exploiting system functionalities, is prohibited unless expressly permitted by the Seller. The Seller may cooperate with payment providers, logistics partners and other entities in order to detect and prevent fraud and may share information related to suspicious transactions where necessary for security and legal compliance.
XII. DIGITAL SERVICES, PERSONALIZATION AND MARKETING
The Store provides a range of digital services enabling interaction with the Store and facilitating the purchasing process. These may include Customer Account functionality, personalized product recommendations, wishlists, abandoned cart recovery mechanisms, marketing communication tools and integrations with third-party platforms.
The Store may use data related to Customer activity, including browsing behavior, purchase history or preferences, in order to personalize content and improve the shopping experience. Personalization may include product recommendations, tailored marketing messages, customized offers or an adaptive Store interface. Such activities are intended to improve the Customer experience and do not in themselves produce legal effects or similarly significant consequences for the Customer.
The Store may send marketing communications, including newsletters, promotional messages or notifications, provided that the Customer has given appropriate consent where required by law. The Customer may withdraw marketing consent at any time. The Store may also use mechanisms designed to remind Customers about incomplete Orders, including abandoned cart emails or notifications.
Certain functionalities of the Store may rely on automated systems, including recommendation engines, fraud detection tools and marketing automation. The Seller does not guarantee the absolute accuracy or completeness of outputs generated by such systems, which remain subject to technical limitations.
XIII. PROMOTIONS, GIFT CARDS AND FUTURE PROGRAMS
The Seller may organize promotional campaigns that allow Customers to purchase Products under preferential conditions. Promotions may include discounts, promotional codes, time-limited offers, special sales, free delivery campaigns or other commercial incentives. Each promotion may be subject to separate rules specifying duration, eligibility and limitations.
Discount codes may be subject to validity periods, minimum order values, limits on the number of uses or exclusion of selected Products. Unless explicitly stated otherwise, discount codes and promotions may not be combined.
The Seller may offer Gift Cards that can be used to pay for Products in the Store up to the available amount. Gift Cards may be issued in electronic form and may be subject to an expiry date specified at the time of issue.
The Seller may also introduce a loyalty program rewarding Customers for purchases or other activity in the Store. The details of any loyalty program, including benefits, points, conditions of participation and expiry of benefits, will be provided in separate rules if such program is launched.
The Seller reserves the right to modify, suspend or terminate promotions, Gift Cards or future loyalty solutions, provided that such changes do not affect rights already validly acquired by Customers before the change.
XIV. PRODUCT AVAILABILITY, FULFILLMENT PARTNERS AND SUPPLY CHAIN
The Store offers a wide assortment of Products presented through an online catalog. Some Products may be supplied directly by the Seller, while others may be sourced, stored, packed or dispatched through external suppliers, warehouse operators or fulfillment partners cooperating with the Seller.
This logistics model allows the Seller to broaden the assortment and improve operational flexibility. Nevertheless, the Seller remains the Customer’s contractual counterparty in relation to the sale of Products offered in the Store, subject to mandatory legal provisions.
Product availability displayed in the Store is indicative and may change dynamically due to stock synchronization, demand fluctuations, supplier updates, warehouse transfers or technical factors. The Seller does not guarantee continuous availability of every Product and reserves the right to update, remove or limit catalog items at any time.
The Seller is not liable for delays or operational issues attributable exclusively to third-party logistics providers, warehouse operators or suppliers, to the extent permitted by law. However, the Seller will make reasonable efforts to assist the Customer and coordinate resolution of delivery or fulfillment issues where such issues affect the Order.
XV. INTELLECTUAL PROPERTY AND USE OF STORE CONTENT
All content available in the Store, including product descriptions, images, layout, branding, logos, trademarks, technical solutions, graphics and other materials, is protected by intellectual property rights. Any unauthorized use, reproduction, distribution, publication, extraction or modification of such content is prohibited without prior written consent of the Seller or the relevant rights holder.
The Store is intended for personal use by Customers. The Seller reserves the right to limit or refuse Orders or access where activity indicates commercial resale, unauthorized commercial exploitation of Store content or abuse of Store functionalities.
XVI. DATA PROTECTION AND COOKIES
Personal data processed in connection with the use of the Store is handled in accordance with the Privacy Policy available on the Store’s website. Information regarding cookies and similar technologies is provided in the Cookies Policy. Those documents form part of the broader legal framework applicable to the use of the Store.
XVII. SYSTEM ERRORS, SERVICE AVAILABILITY AND TECHNICAL DISCLAIMERS
The Seller makes reasonable efforts to ensure that all information presented in the Store is accurate and up to date. However, the Seller does not guarantee that all content, including Product descriptions, images, prices, stock levels, estimated delivery times or technical information, is free from errors, inaccuracies or omissions.
Product images are for illustrative purposes only and may differ from the actual Product due to lighting conditions, screen settings, display limitations, batch differences or manufacturing variations that do not affect ordinary use of the Product.
The Seller shall not be bound by incorrect information displayed in the Store resulting from technical errors, system malfunctions, synchronization delays, data transmission failures or similar anomalies. In particular, the Seller reserves the right to cancel or modify Orders where Product price is clearly incorrect, Product availability is incorrectly displayed or an Order confirmation was generated solely due to system error.
The Seller does not guarantee uninterrupted, secure or error-free operation of the Store. The Store may be temporarily unavailable due to maintenance, upgrades, technical failures, cyber incidents, third-party service disruptions or other circumstances beyond the Seller’s reasonable control. Temporary unavailability does not in itself constitute a breach of obligations by the Seller.
The Seller reserves the right to temporarily suspend or modify Order processing in the event of technical issues, system overload, supply chain disruptions or other operational constraints. Such suspension shall not constitute improper performance where justified by circumstances beyond the Seller’s reasonable control.
XVIII. FINAL PROVISIONS
The Seller reserves the right to amend these Terms for important reasons, including changes in applicable law or regulations, changes in the scope or manner of providing services, introduction of new functionalities or services, changes in payment or delivery methods, technical or organizational changes in the Store, and changes required by security or compliance obligations.
Updated versions of the Terms will be published on the Store’s website. Where required by law, Customers may be informed of significant changes via e-mail or other communication channels. Changes to the Terms shall not affect Orders placed before the changes come into force.
These Terms are governed by Polish law, subject to mandatory provisions of the law of the Consumer’s habitual residence. Nothing in these Terms shall deprive Consumers of protections granted under mandatory provisions of law.
Any disputes arising between the Seller and Customers who are not Consumers shall be resolved by the competent courts of Poland. In the case of Consumers, disputes may be resolved before the competent courts in accordance with applicable law. Consumers may also use out-of-court dispute resolution methods, including the EU Online Dispute Resolution platform previously made available by the European Commission where such tools remain legally and practically available.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms shall be interpreted in a manner consistent with their purpose, mandatory law and consumer protection standards.
